1. Understanding 18A and Donations: What Counts as a Donation?
One of the most engaging topics was around Section 18A of the Income Tax Act, which allows social enterprises to issue tax-deductible receipts for donations. Participants were particularly interested in what qualifies as a donation. For a donation to qualify, there should be no reciprocal benefit to the donor. Meaning the donor can’t receive anything in return for their gift. The session cleared up common confusion around donations and sponsorships, making it clear that sponsorships are not always treated as donations for tax purposes.
2. How to Accurately Value Donations In-Kind
Another highlight was the valuing in-kind donations (like computers or goods) was another key topic. It’s critical that social enterprises don’t overstate the value of donations – for example, a second-hand laptop shouldn’t be valued at the price of a brand-new one. Proper valuation is necessary to avoid legal risks and ensure that donations are accounted for accurately in compliance with tax rules.
